These Terms of Service ("Terms") govern your use of IndianaPBA.com (the "Site"), operated by New Heroic ("Indiana PBA," "we," "us," or "our"). By using the Site, downloading a free resource, or purchasing the toolkit, you agree to these Terms. If you do not agree, do not use the Site.

1. What Indiana PBA is — and isn't

Indiana PBA is an independent, editorially autonomous educational resource about Indiana's Personal Branding Activities (PBA) framework for high-school student-athletes. We are not affiliated with, endorsed by, sponsored by, or operated by the Indiana High School Athletic Association (IHSAA), any Indiana school, school district, state agency, or governing body.

Nothing on this Site is legal, tax, financial, recruiting, or eligibility advice. Content is provided for general educational purposes only and does not replace IHSAA rules, school policies, or guidance from a licensed attorney, accountant, or other qualified professional. Eligibility decisions are made solely by the IHSAA, your school, and other governing bodies — using this Site, including the paid toolkit, does not guarantee eligibility or compliance with any rule.

2. Free resources

Free guides and checklists are provided at no cost in exchange for an email address, which is used as described in our Privacy Policy. You may unsubscribe at any time.

3. Paid toolkit purchases

• The toolkit is sold as a one-time digital purchase. It is not a subscription and does not auto-renew.
• Payment is processed by a third-party payment processor. By purchasing, you also agree to that processor's applicable terms.
• Access is delivered digitally (instant download or emailed link) upon successful payment.
• Refunds: If you're not satisfied, contact us at contact@newheroic.com within 14 days of purchase for a full refund. We may ask what wasn't a good fit so we can improve the toolkit, but a reason is not required to receive a refund.
• Free updates: Toolkit purchases include access to updated files for one year from the purchase date, as described on the product page at the time of purchase.

4. Intellectual property

All content on this Site and in the toolkit — including guides, checklists, templates, text, and design — is owned by Indiana PBA / New Heroic or its licensors and is protected by copyright and other intellectual property laws. Your purchase or download grants you a personal, non-exclusive, non-transferable license to use the materials for your own family's or organization's purposes. You may not resell, redistribute, publicly republish, or create derivative products from our materials without our prior written permission.

5. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) scrape, resell, or redistribute paid content; or (d) use the Site in a way that could disable, overburden, or impair it.

6. No warranty

The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose. Rules and interpretations governing Personal Branding Activities can change, and we do not guarantee that content reflects the most current requirements at all times. Always confirm current requirements with your school's athletic director and official IHSAA sources before making a decision that could affect eligibility.

7. Limitation of liability

To the fullest extent permitted by law, Indiana PBA and New Heroic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of eligibility, income, or data, arising from your use of the Site or reliance on its content. Our total liability for any claim arising from these Terms or the Site will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

8. Indemnification

You agree to indemnify and hold harmless Indiana PBA, New Heroic, and their respective officers, employees, and agents from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

9. Third-party links

The Site may link to third-party websites, including official IHSAA resources. We do not control and are not responsible for the content or practices of those sites.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles.
